If you register and use this web site you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern nzvirtualsport’s relationship with you in relation to this web site.

The term “NZ Virtual Sport” or “nzvirtualsport” or “NZVS” or “us” or “we” refers to the owner of the web site. The term “you” refers to the user or viewer of the web site.

Introduction

By entering the competition you confirm that you are at least 18 years of age, or if you are under 18, you have the consent of your parent or guardian to do so. nzvirtualsport is not a gambling site - it is a competition site.

Country of Residence

The Competition is open to any resident of any country who is 18 years and over, provided that it is legal for that person to enter in their own country, state or jurisdiction.

Changes

We reserve the right to at any time, add, amend or delete any of these terms and conditions and/or the rules of the game. By continuing to participate you are indicating your acceptance and willingness to abide by these changes to the terms and conditions and/or rules.

Registration

To enter the Competition, you need to register and provide accurate and complete registration information. It is your responsibility to update and maintain that information by using the ‘my details’ page or emailing support. Registration is for a single user only. On registration, you will need to select a username and password. We do not permit:

• any other person using your username
• any offensive words or word strings (we reserve the right to edit your player details should we find any of your player details offensive).

When you register to participate in the competition you are confirming you have read, understood and accepted the terms and conditions.

You must keep your password secret at all times. We do not accept responsibility for an entry submitted using your user details.

Submission of entries

All entries must be submitted via this on-line web site. Winning team selections and winning margin selections may be changed any number of times, up until 15 minutes before the start of the game. All updated selections must be re-submitted. We accept no responsibility for late or undelivered entries, communications or for any technical failure, malfunction or difficulty, or any other event causing disruption to or corruption of the Competitions. Any entry which is incomplete, illegible or otherwise does not comply with the Rules and/or these Terms will be disqualified. We accept no responsibility for the predictions or selections made, or information provided, by any person or entity which is displayed on this web site. If you take the comments, predictions, selections and/or information of any other person or entity into consideration you do so entirely at your own risk.

Email Policy

You agree that we may send you emails for the purpose of advising you of changes or additions to this website, of future competitions, or for promotional purposes. However, you have the opportunity to opt out of receiving communications from us and our partners at any time. To be removed from our mailing list, please ensure you click on the opt-out link in any of the emails that are sent to you or amend your details directly in the ‘my details’ page. Links to optout are also provided at the bottom of each email we send. Logging back into the site after opting out is an indication we can email you again.

Advertising Policy

We use Google Adsense, amongst others, for advertising on nzvirtualsport and you should be aware that:

• Advertisers, as a third-party vendor, may use cookies to serve ads on nzvirtualsport.
• Google's use of the DART cookie enables it to serve ads to you based on your visit to nzvirtualsport and other sites on the Internet.

• Through your registration you authorise use to display your username in scoreboards used within the site
• Your first and last name will also be searchable and displayed on the 'Mates' page
• Points and results will be updated can be updated at anytime following the competition of a match. Final results and points will be calculated after all matches have been completed, you will be emailed with your results each week. The judges decision is final and no correspondence will be entered into with regard allocation of points
• We may send you emails for the purpose of advising you of changes or additions to this web site, of future competitions, or for promotional purposes with offers from one or more of our partners
• We are not responsible for any technical or other problems that may arise if you download software from any third party web site (such as Acrobat Reader or Macromedia Flash) or upgrade your browser software to enhance your use of this web site.
• These Terms are governed by and interpreted in accordance with the laws of New Zealand and you irrevocably agree that the courts of New Zealand will (save as expressed below) have exclusive jurisdiction to settle any dispute which may arise in connection with these Terms.

Leagues

Leagues are available to all registered users of nzvirtualsport.

The term or “manager” or “administrator” refers to the creator of a League. The term “player” or “user” refers to the user or viewer of the website.

Create Leagues, Manage Leagues, and Manage Players

Any registered user of NZVS can create a NZVS League. The creator of a League is hereby referred to as the “administrator” or “manager”. The manager will be solely responsible for administering their League, including:

• ensuring League details are correct prior to creating a League
• determining whether players are required to pay an entry fee for the League, and where necessary, providing details of how the entry is to be paid. The manager is responsible for facilitating the payment process. Payment and confirmation of receipt of payment is outside of the control of NZVS.
• determining whether prizes are available for the League, and where necessary, ensuring that prizes are distributed according to the League details
• monitoring the content of message board comments and where appropriate, informing NZVS (via info@nzvirtualsport.co.nz) of inappropriate content.

We reserve the right to remove any League content that is, at the discretion of NZVS, deemed inappropriate or offensive, including but not limited to, administrative messages, message board comments, League details, Leagues and manager or player accounts. The judgement of NZVS is deemed final.

Joining Leagues

Any registered member of NZVS can join a League, (hereby referred to as “user” or “player”) providing either the League is public or the player has been invited to join a private League.

• where a League requires an entry fee, as determined by the manager, the player must ensure that payment is made prior to the start of the League

Any disputes by League managers and players concerning the payment of the entry fee, requests for refunds and distribution of prizes should be dealt with directly between the manager and the player or players concerned. Where necessary, NZVS will facilitate the initial contact between manager and player by providing the player’s email address, as per the ‘my details’ page, to the manager and vice versa.

NZVS take no responsibility for the payment of entry fees or distribution of prizes.

When you register to participate in a League you are confirming you have read, understood and accepted the terms and conditions.
